In the main, it depends on the attitude of the relevant rights holder towards fanfic, ranging from strict enforcement, through tolerance, to welcoming and supporting fan involvement.

Star Trek is an interesting point - the link mentions Star Trek in reference to Viacom (anti-fanfic) while there are a number of ST:TOS based fanfics (which was under Paramount - pro-fanfic)
